Rates And Terms

Parties will be billed equally per side in accordance with the rates listed below for Mediation or Arbitration, which includes, but is not limited to: preparation time, correspondence, attendance at the Mediation or Arbitration, travel time, room rental fees where necessary, telephone conferences (before and/or after the Mediation or Arbitration), reporting of the Mediator’s or Arbitrator’s Report to the applicable court, billing and collection (including, but not limited to any applicable attorney’s fees and costs for those efforts).

For in-person appointments, please reserve a full day on Diane’s calendar and provide location details in the form on the Contact page. 

Mediation Rates:

$250.00 per hour per side for two-sided disputes

$200.00 per hour per side for three-sided disputes

$180.00 per hour per side for four-sided (or more) disputes

Arbitration Rates:

$500.00 per hour, divided and invoiced equally amongst all participants

Minimum Fees:

A minimum fee of three hours will be charged for half-day Mediations.

A minimum fee of six hours will be charged for full-day Mediations.

A minimum fee of three hours will be charged for all Arbitrations.

Travel Time and Expenses:

Travel time will be billed at $300.00 per hour.

Travel expenses including airfare, mileage, parking, lodging, meals and other related expenses. All travel time and expenses will divided and invoiced equally amongst all parties.

Payment:

All attorneys and/or their law firms involved in the Mediation or Arbitration are responsible for ensuring all services provided are timely paid. Failure to do so, will result in the attorney or law firm being liable for unpaid fees, costs, cancellation fees, and/or collection efforts, which may include my attorney’s fees and costs for such efforts. Unrepresented parties must pay at the time the Mediation or Arbitration conference ends. A deposit may be required for unrepresented parties in order to secure payment.

Invoices will be e-mailed upon completion of the Mediation or Arbitration unless other arrangements have been made by a party to the dispute. Diane Barnes-Reynolds reserves the right to require an advance deposit, payment, or alternative method of payment be provided at the time of booking to secure full payment for services after the Mediation or Arbitration takes place.

Payment may be made by check or credit card.

Cancellations:

A cancellation of a Mediation or Arbitration may be made up to one week (seven calendar days) prior to the date of scheduled Mediation or Arbitration without a penalty or fee. In order to cancel a scheduled Mediation or Arbitration, an e-mail should be sent to Diane and copied to all parties with a “read” and “delivery” receipt to ensure receipt and timely cancellation. Late cancellation of Mediation or Arbitration will result in a fee of $1,200.00 for half-day or $2,400.00 for full-day, which will be invoiced equally amongst all parties unless there is another arrangement agreed in writing by all parties and the Mediator/Arbitrator. Late cancellation fees will not be waived unless another Mediation or Arbitration is booked in the originally-scheduled time slot.
